Article 2 – Purpose and scope

These terms govern every sale concluded on www.dreamsfragrance.com between the seller and a consumer within the meaning of the French Consumer Code. Placing an order implies unreserved acceptance of them. The seller may amend these terms; the version applicable is the one in force on the day of the order.

Article 3 – Products

The products offered are new, sealed perfumes delivered in their original packaging. Photographs and descriptions are indicative: houses change boxes, graphics and bottle shapes without notice, without this affecting the authenticity or composition of the product. Products are offered subject to availability.

Article 4 – Prices

Prices are shown in euros, inclusive of all taxes. As the seller benefits from the French VAT exemption scheme (article 293 B of the French Tax Code), no VAT is charged. Shipping is free, with no minimum order, to all destinations served. The price paid at checkout is final: no additional charge is requested on delivery. The seller may change prices at any time; products are invoiced at the rate in force when the order is validated.

Article 5 – Orders

The customer selects the products, checks the contents of the basket, provides delivery and billing details, then validates the order. Validation, after a summary and acceptance of these terms, forms the contract. A confirmation email is sent to the customer. The seller may refuse or cancel any order for legitimate reason, in particular a previous payment dispute or a manifestly abnormal order.

Article 6 – Payment

Accepted payment methods are Visa, Mastercard, American Express, PayPal and Google Pay. Transactions are encrypted and handled by our payment provider; the seller never has access to the customer’s card details. Orders are processed only once payment has been received.

Article 7 – Delivery

Destinations served, timescales and tracking arrangements are set out in our shipping policy, which forms an integral part of these terms.

Orders are prepared within 1 to 2 working days, then delivered in 4 to 8 working days depending on the destination, 5 to 10 working days in total. A tracking number is emailed when the parcel leaves. For destinations outside the European Union, shipments are made duties and taxes paid where that service is available.

It is the customer’s responsibility to check the accuracy of the address provided. Should a parcel arrive damaged, the customer must inform the seller on receipt, with photographs.

Article 8 – Right of withdrawal

Under articles L.221-18 et seq. of the French Consumer Code, the customer has fourteen days from receipt of the product to withdraw, without giving reasons.

Hygiene exception. Under article L.221-28, 4° of the French Consumer Code, the right of withdrawal cannot be exercised for goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection. Accordingly, only unopened, untested bottles with an intact plastic seal, in their complete original packaging, may be returned.

To exercise this right, the customer writes to contact@dreamsfragrance.com. A prepaid return label is provided: return costs are borne by the seller and no restocking fee applies. The refund is made to the original payment method within a maximum of fourteen days following receipt and inspection of the product. Full details are in our returns and refunds policy.

Article 9 – Legal guarantees

Independently of any commercial guarantee, the seller remains bound by:

• the legal guarantee of conformity under articles L.217-3 et seq. of the French Consumer Code. The customer has two years from delivery to act; defects appearing within twenty-four months of delivery are presumed to have existed at that time;
• the guarantee against hidden defects under articles 1641 et seq. of the French Civil Code. Action must be brought within two years of discovering the defect; the customer may then choose between returning the product for a refund and keeping it against a partial refund.

These guarantees cover neither normal wear, nor damage resulting from unsuitable storage conditions, nor causes external to the product.

Article 10 – Authenticity

The seller sources from official channels and authorised partners. Should a defect of authenticity be found on a product purchased on the site, the customer is refunded in full, return costs included. Our commitments are detailed on the authenticity guarantee page.

Article 11 – Personal data

The processing carried out, its purposes, retention periods and the customer’s rights under the General Data Protection Regulation are described in our privacy policy.

Article 12 – Intellectual property

All elements of the site (texts, visuals, structure, design) are protected by intellectual property law. Brand names and logos belong to their respective owners and are used solely to identify the products resold.

Article 13 – Force majeure

The seller cannot be held liable for non-performance due to force majeure within the meaning of article 1218 of the French Civil Code, in particular carrier strikes, natural disasters or interruption of communication networks.

Article 14 – Complaints and mediation

Any complaint should be addressed to contact@dreamsfragrance.com. Failing an amicable solution, the customer may use the consumer mediator Médiation-Net (www.mediation-net.com) free of charge, or the European online dispute resolution platform (ec.europa.eu/consumers/odr).

Article 15 – Applicable law

These terms are governed by French law. In the event of a dispute, the competent French courts have jurisdiction, without prejudice to the mandatory provisions protecting consumers.
